water in basement from common area


Water from common area leaked into finished lower level (carpet, ceiling,lights, etc) as confirmed by two tradespeople (water remediation and plumber). Association has not done regular maintenance, i.e., cleaning out gutters on regular basis, cleaning stormwater drain which exits near huge tree that has never been pruned or evaluated for risk, and grade on soil leading from foundation (a problem they were already aware of). Manager says I am responsible for interior damage but my insurance has rejected my claim because incident is only covered under flood insurance (which I do not have and which association never recommended that I purchase.) Since previous maintenance has been less than professional and totally unsupervised, how should I deal with issues both inside and out?
